What is CMR (Convention Marchandise Routier) Certificate?

What is CMR Certificate?

CMR Certificate, international road transportIt is an official transport document based on the international agreement called Convention Marchandise Routier, signed in 1956, which regulates the rights and obligations of the parties regarding the transportation of goods in Turkey. This document creates the legal framework of transportation by putting the transportation relationship between the carrier, sender and receiver in writing. It is one of the basic documents documenting the conditions under which transportation is carried out, the type and quantity of the cargo transported and the delivery points.

CMR document is not only a shipping document but also a transportation contract. It is the main reference document that determines which party will assume which responsibilities in case of damage, loss or delay that may occur during the transportation process. Thanks to its international validity, it creates a common ground between the legal systems of different countries and provides a standard framework for resolving disputes.

What is the use of CMR Certificate?

The main function of the CMR document is to record the conditions of transportation in international road transportation in a clear and binding manner. Thanks to this document, critical details such as the type of goods transported, packaging status, gross weight, sender and recipient information become official. It helps prevent possible disputes by clarifying the responsibilities between the parties throughout the transportation process.

In addition, the CMR document plays an important role in customs procedures and insurance processes. Customs administrations evaluate through this document whether the transportation is carried out in accordance with international rules. Insurance companies carry out the compensation process in cases of damage or loss based on the CMR document. In this respect, CMR is an indispensable document that provides both operational and legal assurance.

For Which Transports Is CMR Certificate Mandatory?

CMR certificate is compulsory for commercial goods transportation between two different countries where the transportation is carried out by road. It is sufficient that at least one of the countries where the transportation begins and ends is a party to the CMR Convention. This enables the document to be implemented in a wide geography, especially in Europe. Internal transports are generally not covered by CMR; However, every international road shipment is subject to this document.

It is also important that the goods transported are commercial in terms of CMR obligation. Personal belongings, household moves or special purpose moves may not be covered by CMR, with certain exceptions. However, it is mandatory to issue a CMR certificate for cargoes that have invoices and commercial value and are carried out within the scope of export and import. In transportation without this document, both the carrier and the sender may face serious legal and administrative risks.

What Legal Responsibilities Does the CMR Certificate impose on the Carrier?

The CMR document imposes certain legal responsibilities on the carrier from the moment it undertakes the transportation until the cargo is delivered. The carrier is obliged to deliver the cargo to the buyer in its complete and undamaged condition when received. The carrier may be held liable for losses, damages or delays that occur during transportation, regardless of whether fault is sought or not.

The CMR Convention defines the carrier's liability within certain monetary limits. These limits are generally calculated based on the value per kilogram of the goods transported. However, these limitations may be eliminated in case of the carrier's gross negligence, intentional behavior or violation of the conditions of carriage. Therefore, the CMR document is not just a document for the carrier; It is a document of responsibility that may have serious financial and legal consequences.
